    Yes, if you are already on the tenancy agreement as a joint tenant automatically you are entitled to succeed the tenancy. If you name is not already on the tenancy as a joint tenant, do notify the relevant Council of the death of your spouse by providing the death certificate and marriage certificate.

     

    Similarly, a partner of a secure tenant can also succeed the tenancy of their partner after the death of the partner in question. In order to succeed the tenancy of your deceased partner you have to approach the relevant Council with the proof that you are his or partner prior to death and the documentary proof to show that you have lived in the property in question 12 months prior to the death of your partner.
